Municipal Council, Duties and Decision-Making

Municipal Council

• It is the representative body of the Municipality;
• Function based on the regulation approved by the councilors themselves;
• It exercises its decision-making through decisions and resolutions, which are published on the official website of the local self-government unit and displayed in places designated by the unit for public announcements.
• It is composed of: Mayor; Deputy Mayors; Secretary; Commissions, Boards, Councilors.

Council Meeting

• It is called at the request of the President of the Council; at the request of the Mayor, at the request of no less than 1/3 of its members; it is also called by the prefect for issues related to the exercise of his functions.
• It is considered valid when a majority of all members of the council participate in it, except in cases where another majority is required for decision-making.
• It is held open or closed to the public. At the request of the President of the Council or one fifth of the members of the municipal council, the meetings of the municipal council may be held closed, when no less than three fifths of all its members have voted for this.

Duties and Decision-Making of the Council

• Decision-making with or without public consultation;
• Decision-making based on councilor participation in voting.

The municipal council decides for

• Elects the council committees from its own composition and approves the internal regulation of its functioning; approves the budget and its amendments, the maximum number of employees, local taxes and fees. With public consultation and the decision is approved by a majority vote of all members of the Council.
• Elects, respecting the law on gender equality, the chairman, deputy chairmen, the secretary of the council and the council representatives in the region and dismisses them; approves the acts of establishment of enterprises, commercial companies, as well as other legal entities that it creates itself or with which it is a co-founder; decides on obtaining loans and repaying obligations to third parties; decides on the creation of joint institutions with other local self-government units, including the subject of joint competences or with third parties; decides on the granting or declaration of the end of the councilor's mandate; Without public consultation and the decision is approved by a majority vote of all members of the Council.
• Approves the alienation or granting of use of third party properties. With public consultation and not less than three-fifths of the total number of council members.
• Approves norms, standards and criteria for the regulation and discipline of the functions assigned to it by law, as well as for the protection and guarantee of the public interest. With public consultation and by a majority vote, in the presence of more than half of all council members.
• Approves the level of salaries and bonuses of employees and other persons, elected or appointed; organizes and supervises the internal control of the municipality; decides on the initiation of judicial proceedings on matters within its competence; decides on the symbols of the municipality, the naming of streets, squares, territories, institutions and buildings in the jurisdiction of the municipality; grants honorary titles and incentives; decides on the rules, procedures and methods of carrying out delegated functions, based on and for the implementation of the law by which this delegation is made to the municipality. Without public consultation and are dealt with by majority vote, in the presence of more than half of all members of the council.

Acts of the Municipal Council

• They are published on the official website and displayed in public places, designated by the council with free public access, within the territory of the unit and, as far as possible, the council also determines other forms of their publication.
• They are promulgated within 10 days from the date of their approval and enter into force 10 days after promulgation. Acts of an individual character enter into force on the date of their notification to the subjects included in them.
